This circular is about: Initiation of bargaining for the Support Staff in Schools' and Kaiarahi i te Reo, Therapists, ATSSDs and Special Education Assistants' Collective Agreements (CA).

The action required is: To bring the attached initiation of bargaining notices to the attention of all employees whose work is covered within ten days of receipt of the notice.

It is intended for: Board of Trustees, Chairpersons and Principals of all state and integrated schools.

Initiation of Bargaining

The unions have today formally initiated bargaining for the renewal of two new collective agreements covering the following staff employed by school boards:

- Support staff (i.e., administrative and associate staff); and

- Kaiarahi i te Reo, occupational therapists and physiotherapists, assistants to teachers of students with severe difficulties and special education assistants.

The notices of initiation set out the claimed coverage for each proposed new collective agreement. The only change from existing coverage is within the Support Staff in Schools' Collective Agreement where the unions seek to cover after-school carers employed by boards. This group is currently exempt from coverage and the initiation notice will need to be bought to their attention. Full details of existing coverage can be found in Part One of each collective agreement, available on the Ministry of Education website at www.minedu.govt.nz/goto/employmentagreements.

Boards are required to bring the relevant initiation to the attention of any employee potentially covered by the relevant proposed collective agreement as soon as possible but no later than ten days after receipt of this notice. The Kaiarahi i te Reo Collective Agreement notice of initiation will apply to a minority of schools.

Notice of Initiation of Bargaining

Support Staff in Schools

On 11 July 2007 the Unions listed below formally notified the Ministry of Education that they intend to seek a collective agreement covering every employee who is employed by an employer as either an administrative or an associate support staff employee (and whose position is not specifically exempted) in a state or integrated primary, secondary or composite school.

For the purposes of this notice, "employer" means every board of trustees in a state or integrated primary, secondary or composite school, attached community learning centre, or commissioner as appropriate, as defined in the Education Act 1989.

The intended parties to the collective agreement will be the New Zealand Educational Institute - Te Riu Roa, the Service and Food Workers' Union and the Secretary for Education acting under delegation from the State Services Commissioner issued in accordance with the State Sector Act 1988. The agreement sought would bind all employers and all members of the New Zealand Educational Institute - Te Riu Roa or the Service and Food Workers' Union coming within the coverage of this proposed collective agreement.
